Welcome to our website. If you continue to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern CreamHeaven’s relationship with you in relation to this website.

The term “CreamHeaven” or “us” or “we” refers to the owner of the website. The term “you” refers to the user or viewer of our website.

The use of this website is subject to the following terms of use:

• The content of the pages of this website is for your general information and use only. It is subject to change without notice.

• Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

• Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

Misuse and Safety.

1. The gas inside our Cream Chargers is Nitrous Oxide. Inhalation of Nitrous Oxide carries a risk of serious health consequences. The risks of such misuse include narcosis, asphyxiation and potentially, death.

2. We have a policy of not selling Goods to any person whom we believe may be under 18 years of age or whom we believe may misuse the Goods.

3. You confirm that you are the named purchaser and at least 18 years of age, and understand that you will be committing an offence if you provide false information to us.

4. You confirm that you do not propose to misuse the Goods or to supply the Goods to anyone you believe (i) may be under 18 years of age, or (ii) may misuse the Goods.

5. We reserve the right to refuse to sell our Goods to any person who we suspect may misuse them.

6. We reserve the right to refuse to sell our Goods to any person who we suspect may supply the Goods (i) to persons under 18, or (ii) to persons who may misuse the Goods.

7. We reserve the right to refuse to sell or to limit the number of Goods sold to any person.

8. Without prejudice to the generality of clause 8.5 or any defences which may be available to us, insofar as you disregard the risks associated with inhalation of Nitrous Oxide, the warnings and instructions.

Misuse

Our cream chargers must only be used for the preparation of food.

The cream chargers contain a gas called Nitrous Oxide that can be abused in the same way that glue or solvents are. In order to combat this we require that any customer purchasing more that a certain volume of our products to confirm they are aware of the issues and will make every effort to prevent our products from being misused. Also, we issue this warning if we suspect that you intend to misuse we will refuse to sell any equipment to you. We will refuse to do business with you in the future and your account (name, addresses etc) will be blocked.

It is an Offence to sell cream whipping chargers for the purpose of inhalation - punishable by up to 6 months jail and/or a large fine. The risks of such misuse include Narcosis, Asphyxiation and potentially, Death.

Keep out of reach of children.

We will not sell to anyone under the age of 18.

We require confirmation of your age when you create an account with us.

If you are a parent, guardian, teacher etc and suspect that a child in your care is misusing our products please contact us.

We can arrange for a collection and refund of any items purchased illegally and/or for misuse.

Product Safety

Before using our whipped cream making equipment you must first read the manufacturers instructions. This will show you how to safely charge your cream using the cream whipping chargers.

No more than 1 charger should be released in a 1/4L or 1/2 Litre Whipper and no more than 2 chargers for a 1 Litre Whipper. An explosion could occur from excessive pressure if you use more than stated.

These chargers contain liquid Nitrous Oxide under great pressure.

Any attempt to pierce the sealing cap of these chargers without the correct equipment could result in EXPLOSION INJURY & SERIOUS FREEZE BURNS.

EXPLOSION DANGER - Do Not Incinerate or Expose chargers To The Sun or Any Heat Source.

Temperature Must Not Exceed 50C.

Do not dispose of full chargers. They may cause someone else an injury!

Keep out of reach of children.

DO NOT FLY with CREAM CHARGERS!

Pressurised gas cartridges must not go on an airplane at all. No excuses, you may be prosecuted.

Privacy Policy

We collect the IP address [Internet Protocol] and e-mail address (where possible) of visitors to our Website, the e-mail addresses of those who communicate with us via e-mail, aggregate information on what pages consumers access or visit, user-specific information on what pages consumers access or visit, information volunteered by the consumer, such as survey information and/or site registrations.

The information collected is used to improve the content, used to customize the content and/or layout for each individual visitor, used to notify consumers about updates to our Web site, not shared with other organizations or third parties for any purposes.

Customers who supply us with their telephone number online will only receive telephone contact from us with information regarding orders they have placed online.

From time to time, we may use customer information for new, unanticipated uses not previously disclosed in our privacy notice. If our information practices change at some time in the future we will post the policy changes to our website to notify you of these changes and provide you with the ability to opt out of these new uses. If you are concerned about how your information is used, you should check back at our website periodically.

Upon request we provide site visitors with access to all information [including proprietary information] that we maintain about them, financial information (e.g., credit card account information) that we maintain about them, unique identifier information (e.g., customer number or password) that we maintain about them, transaction information (e.g., dates on which purchases were made, amounts and types of purchases) that we maintain about them, communications that the consumer/visitor has directed to our site (e.g., e-mails, customer inquiries), contact information (e.g., name, address, phone number) that we maintain about them .

Shipping Information

If you are having a delivery problem please contact the courier - they are much better placed to help. If you have no luck with them then please send us a message.

Once your goods have been dispatched you will receive an email confirmation. This email has a tracking number in it - go to www.fedexuk.net or www.businesspost.biz or www.UPS.com type in the number for up to date tracking info.

If no-one is in the courier will leave a card with details of how to get hold of your parcel. Read the card! You MUST contact the courier within 5 DAYS or the delivery will be assumed refused and you will be charged up to £7.50.

FULLY GUARANTEED NEXT DAY DELIVERY
- This applies to Courier Deliveries within the United Kingdom ONLY. 

If our courier fails to attempt a delivery the next working day then, at your request, we will refund the courier charge. For conditions see notes at the bottom of this page.

WE WILL NOT SHIP TO:
Due to incidents of misuse of the Nitrous Oxide chargers we will not ship to University Halls of Residence. For Colleges, Schools, and Hospitals we will contact you to verify use.

Off-Shore - We cannot send compressed gas cartridges by air. Therefore we use a road-freight service to off-shore destinations. Email us for a quote.

Saturday Deliveries - Saturday deliveries are expensive, so save yourself some money and order before Friday.

DELIVERY GUIDE -  You must provide us with as much address information as possible.

If you provide us with an incorrect address you will be charged an extra fee to have a new address for the consignment.

Someone (anyone) must be at the given address to sign for the delivery between 9:00am and 6:30pm (for standard Next Day service). Therefore we recommend delivery to a work address where someone is willing to sign for the goods during the working day.

Theft
We accept no liability for a successfully completed delivery that you do not take possession of. We are delivering to an address NOT an individual. Therefore if our courier logs a consignment as having been delivered you must assume it has been stolen - either by the courier or by someone at your address. In these cases we will provide you all the help we can, but it is up to you to contact and deal with the Police.

Other notes.
- You may specify a delivery day - we will hold onto your consignment until the day before.
- If you need to change the delivery address after dispatch the couriers charge a re-booking fee of £7.50. If your package is damaged do not accept delivery.
- Please make sure we have a valid phone number so you can be contacted should there be any delivery problems.
- If you place your order after 1pm and require your goods urgently, we may be able to prioritise you - email us with your query and contact information (include your telephone number if possible) by filling out our Contact Form.

We try very hard to get your delivery to you without wasting your time, but we require your help for this to happen. Please give us as much address information you can.

POST - We prefer to use our courier for all orders.
If you want postal delivery we use First Class Recorded (which is unreliable) or Special Delivery (which is very reliable).
These services require a signature. If you are out you will be carded, please read the instructions on the card. Your dispatch email has a reference number on it use this to and go to www.royalmail.com or call Royal Mail on 08457740740. We cannot send compressed gas by Royal Mail to Scotland or UK off-shore.

Delivery Guarantee Notes -
This offer applies to Next (working) Day (Mon-Fri) deliveries only. This offer applies to orders placed over this website only, and is not extended to include any special instructions you may add in the comments box. This offer only applies to UK mainland addresses. You must obviously give us the correct delivery address and post code.

Free Next Business Day Delivery, is available to customers purchasing £250 or more at one time. If you qualify for free delivery you will see the option when you check out. Unfortunately our saturday delivery service is not included in the free shipping offer.

Low Stock/No Stock Policy -

On rare occasions the specific product you have ordered may become out of stock.  Unfortunately we do not have the staffing resources to call every customer and ask them what their replacement preference would be, so in an effort to avoid the recruitment of further staff, which would increase our opertating costs and eventually our pricing, we have devised a policy which we believe to be fair & effective for both You and Creamheaven.co.uk. 

Our policy on occasions such as this when the advertised item is out of stock is: to substitute the out of stock item with a product of at least equal or greater quality.

Returns

Our Returns Policy conforms to a Web Code of Practice.

At CreamHeaven.co.uk we want you to be delighted every time you shop with us. Occasionally though, we know you may want to return items.

By law, customers in the European Union have the right to withdraw from the purchase of an item within seven working days of the day after the date the item is delivered. This is generally referred to as a 'cooling off' period. We at CreamHeaven.co.uk give you the full seven days.

We regret that we cannot accept cancellations of contracts for the purchase of food products where the item has been unsealed (this includes Syrups).

The Returns Procedure:
To cancel your purchase within the seven-day cooling-off period, please email sales [at] creamheaven.co.uk, giving the reason for the return. We will then advise you on our preferred method of return - usually we will arrange for our courier to collect at your cost. You are welcome to send back using your own shipper as long as you have Proof of Delivery. Please package the relevant item(s) securely. If you are dispatching it yourself send it to us at the address on the Invoice so that we receive it within 7 days of the day after the date that the item was delivered to you. You must insure the consignment.

Once the goods have been received back with us they will be inspected and if in good condition you will be refunded the full purchase price. You will not be refunded the original shipping cost.

Please note that you are be responsible for the costs of returning the items to us unless we delivered the item to you in error, or if the item is damaged or defective.

Cancellation of Orders that HAVE NOT been shipped.
As soon as we receive notice of cancellation of an order prior to it being shipped, we will refund the full cost of the order - unless we have had to pre-book special shipping charges for it. Please note - once we begin the delivery process you will not be able to cancel any contract you have with us for additional services carried out by us (eg: giftwrapping).
